And I thank the organisers of this event for inviting me to speak on behalf of the Independent Investigative Mechanism for Myanmar, but most of all, for organising this event, which is so important, so timely, to remember after four years what happened in 2017 and the violence that was inflicted on so many human beings, so many individuals.<\/p>\n\n\n\n<p>The consequences of that violence continue today. The consequences are tragic, and they go on. We have hundreds and hundreds of thousands of Rohingya living as refugees in camps with their lives on hold, in horrible conditions, with generally one hope \u2013 one shared hope \u2013 to go back home, to live a normal life in the country in which they were born.<\/p>\n\n\n\n<p>The world, unfortunately, is full of tragic events and suffering. And we\u2019ve seen that recently. For example, Afghanistan has dominated the news headlines this week. One crisis after another. And each one, we all turn our eyes to, many of you turn your hearts to. You\u2019re concerned about what happens. But then the news cycle moves on and people tend to forget. But the suffering of those who were the victims of that event continues. And if we want to, in any way, alleviate the suffering and provide some restoration to victims of what they lost, it requires a very long and persistent effort. It requires a concentrated commitment by each of us to continue to fight for justice, for some recognition of what happened, and for restoration of rights that were lost.<\/p>\n\n\n\n<p>One of the things we\u2019ve also learned is that when violence happens with no consequences, when the perpetrators are allowed to enjoy impunity, it\u2019s not just the last group that suffered that is affected. The impunity ferments a cycle of violence affecting more and more people.<\/p>\n\n\n\n<p>We see that today, tragically, in Myanmar, where the way that the military forces acted in 2017 and that the impunity that they enjoyed for those crimes to date has led to \u2013 I think most of us would recognise \u2013 to the situation today where there is a belief that they are above the law and need not fear facing justice for crimes they commit. To break the cycle of impunity, it is very important that those who commit the most serious crimes eventually face justice.<\/p>\n\n\n\n<p>Serious crimes in international law are often called \u201ccrimes against humanity\u201d. Why do we call them crimes against humanity? Because the victims of such crimes are not just the groups targeted, the individuals targeted but all humanity suffers when any group is violently and inhumanely targeted.<\/p>\n\n\n\n<p>I thank all of you attending this event for all the work that you have done to date and I ask each of you to please persist. It\u2019s four years now. It\u2019s likely to be a much longer process, but we must persist and commit ourselves to this long journey to try to seek justice.<\/p>\n\n\n\n<p>Thank you.<\/p>\n\n\n\n<p><span I want to celebrate life. I do not want to speak to an abstract international community. I want to speak to my Rohingya brothers and sisters and talk to them about a possible future. It is the unacknowledged genocide that has made it impossible for me to do what I want to do today. I don&#8217;t think our conscience needs to go to legal definitions to acknowledge that the Rohingya is killed simply because she is a Rohingya. By common sense, that is genocide. But we must have an international legal acknowledgment in order for the possibility of legal redress to begin.<\/p>\n\n\n\n<p>At least since 2017, they are killed and their land destroyed, so that their name can be extinguished from the place where they have hung around in, one way or another, before any idea of the nation-state. Genocide of the Rohingya has been acknowledged by the United Nations, even by the Congress of the United States. But it cannot be acknowledged by the International Criminal Court. Subterfuges are brought up regularly.<\/p>\n\n\n\n<p>Capital investment is also involved here. Greed combines with prejudice, and nationalism is ethnicised. This is a global problem. Ethnicised nationalism destroys what is politely called \u201cillegal immigrants,\u201d citizenship redefined. To greed and ethnicity is added sex. Genocide and land grab plus greed adds brutal rape and castration as spectacle; as weapon. Rape as weapon is also declared by the United Nations. Plenty of videographic evidence, with no more than voyeuristic use, it seems. Rather listen to a Rohingya brother speak in rage: They themselves describe their condition as subhuman, as Nasir Uddin with 500+ hours of videos can witness. Therefore we must not think of the international acknowledgment of genocide, which will make it politically possible for the Rohingya to be established on their own ground, as an end, but as a beginning.<\/p>\n\n\n\n<p>No access to being-human is possible unless the children can be trained in the intuitions of democracy, which is the awareness of other people. I am dreaming the impossible dream of citizenship. The Rohingya vote cannot be up for sale. It is only for the sake of that impossible dream that I exhort the international community not so much to memorialize but to acknowledge genocide and, at the same time, insist on divestiture. We must be able to think, of the time after this acknowledgment is made and the Rohingya are more stable.<\/p>\n\n\n\n<p>I am a teacher of the Humanities, beyond the discipline, as the instrument of the ethical. <em>Our<\/em> work begins in that stability. Countries in the region have not come forward to make this acknowledgement. As an Indian I make an appeal to our best instincts: come forward for these brothers and sisters. I have been involved with the Rohingyas one way or another since the late eighties. But for me as a person who has given her life to poetry, a mention of the great 17th century Rakhine poet Alaol is necessary here. I have no blood quantum theory to tell me if he is a true Rohingya. I only know that he spoke of the Rohangs as his audience and that I met him, across the hills of the Arakan region, across three hundred years, as a young person, thanks to my Mother, as a classic from the area.<\/p>\n\n\n\n<p>He wrote of women who would not be raped, and people who would not be killed. It is in his name that I ask you all, let us not stop at merely commemorating genocide, rape, and greed. Celebrate the historical future, as only memory can, by pushing, hard, for legal acknowledgement. I embrace you all, as the struggle goes on.<\/p>\n\n\n\n<p>I end by picking up the Rohengya self-description: &#8220;<em>amanush, manusher odhikare banchito kore jare, shommukhe dariye rekhe, tobu allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p>August 25<sup>th<\/sup> is a day on which we remember those who lost their lives in Myanmar\u2019s genocide. It\u2019s a day to honour and show solidarity with the survivors in their pursuit for justice, restitution and recognition of the Myanmar\u2019s crimes against them. For me, it is also a day to reflect honestly on our own forms of solidarity. This year, our Rohingya brothers and sisters attempts to organise memorial events in the camps in Bangladesh have been hampered by authorities. The Bangladesh authorities cannot take their memories though. Instead, they remember in in silence in their shelters.&nbsp; This year, it seems, has been the year of many silences.<\/p>\n\n\n\n<p>Since the horrors of 2017, there have been important developments in Rohingya activism.&nbsp; Rohingya-led and organised initiatives in international circles are no longer the exception \u2013 they are the norm. Using token Rohingya voices within the parameters of NGO-defined advocacy projects no longer goes unchallenged. Rohingya have become the centre of knowledge-production about themselves.<\/p>\n\n\n\n<p>And yet this past year has been a huge challenge for Rohingya activists, Myanmar activists and those working with them. Not least because the crimes of Myanmar\u2019s generals have engulfed the entire country, and because the pandemic (with its man-made factors) has sadly taken the lives of activists,&nbsp; their friends, colleagues and family members. Week after week messages and social media feeds have become a stream of seemingly endless notifications of deaths and arrests. People desperately trying to find safety from military violence, or else trying to secure oxygen against the odds for poorly family members. With the heavy emotional toll on all the people of Myanmar including Rohingya and with the 360 degree conflicts as a result of the Feb 1<sup>st<\/sup> military coup, it is amazing that activists have the energy to continue with their work at all. For my activist brothers and sisters, looking after and being kind to yourselves is paramount \u2013 emphatically it does not deplete from the value of your work. As outsiders, our solidarity can also mean not judging you for your ways of grieving, for your rage, your anger, your despondency, not judging you for the way you chose to fight back, who you do or do not chose to join forces with, or the silences you chose to hold. I am still here \u2013 we are still here.<\/p>\n\n\n\n<p>Another loss this year, has been a loss of hope. The homeland to which so many Rohingyas are hoping to return is in dire straits. And the human rights situation for Rohingyas in Myanmar, Bangladesh and elsewhere has deteriorated. Importantly, human rights abusers are no longer concentrated within the Myanmar military but are also from other groups \u2013 non-state armed groups in Rakhine, exploitative and violent gangs operating cross-border, and hybrid state and non-state criminal networks. Seemingly there is no escape.<\/p>\n\n\n\n<p>With the acceleration of these other forms of abuses come silences.&nbsp; The silence of Rohingyas in camps and in diaspora fearing reprisals and consequences for families, friends and communities. The silence of internationals worried about the precarious position of Rohingyas, unable to navigate the situation to find strategies that will help and not damage. And then, resulting from all those silences is a lot of blame and anger; feelings of loss, frustration and impotence. Sometimes we need to remind ourselves that it is the absence of solutions, opportunities and protections for Rohingya survivors that enables the insecurities, violence and exploitation. It\u2019s the structural issues that we need to keep collectively focusing on \u2013 not just the individuals who turn to crime, or the actions of leaders who are powerless to solve the violence.<\/p>\n\n\n\n<p>Whilst holding in mind, that Myanmar perpetrated the genocide against Rohingyas, and holding in mind that justice can only be done once Rohingyas are able to thrive and flourish in their homeland, we also need to recognise and act on the needs of Rohingyas everywhere. Rohingyas should be able to have decent lives and futures outside their country too. Maybe it\u2019s sometimes justified to temper our solidarity with our silences to make sure we do no harm. But there is no good reason to be silent about the states and international structures that create barrier after barrier for Rohingya genocide survivors who simply want a future \u2013 a future in which they can live safely, proudly and openly as a community. With that in mind, I am still here \u2013 we are still here.
