Myanmar’s demographic engineering is based on an ideology that does not recognize the existence of a Rohingya identity. “There is no such people,” the Myanmar authorities say, “these are illegal and uninvited invaders.” That is, Rohingya boys and girls are murdered when their identities are denied them, and those who survive must accept the new group identity set by the killers – “foreigners in Bengal.” “The brainwashed public in Myanmar received the destruction of the Rohingya identity,” says Zarani, “he backs up the murder and turns the victim into a terrorist.”<\/p>\n\n\n\n

Zarni also sheds light on the political context. “There is a consensus in the country – among all classes and social groups, even among non-Rohingya Muslims – that these are illegal invaders,” he said. “They argue that this is not a race or religion issue, but an issue of immigration. Some also claim that it is a takeover attempt by global Islam backed by the dual ethics of the hypocritical West.<\/p>\n\n\n\n

The prevailing position in the country, coupled with historical trends of racism toward dark-skinned people, English colonialism and fifty years under military rule – are leading the Rohingya genocide to total support. Acting Myanmar leader, Nobel Peace Prize winner Ong San Suu Kyi, who has high hopes for it in terms of democracy and human rights in the country, is also part of these trends. “Suu Kyi, despite her education in Oxford and decades of living in the liberal West, is a racist who cannot accept the fact that the Rohingya are part of Myanmar society,” says Zarani. According to him, “Suu Kyi does not function as opposition to the generals. It consistently praises ethnic cleansing and it also benefits politically by justifying the military’s activities to the world.”<\/p>\n\n\n\n

Indeed, when Myanmar needed to be represented before the International Court of Justice, it was Suu Kyi herself who stabilized in The Hague. Despite the temporary injunction which is a warning to Myanmar and the protection of the Rohingya, it would be a mistake to conclude that Suu Kyi lost in the international arena. Michael Becker, an international public law expert who teaches at Trinity College Dublin – who also worked for four years at the International Court of Justice – says it is very difficult to prove a crime of genocide. “Even if there is a lot of evidence of atrocities, it is difficult to prove the legal definition of genocide and especially the requirement to prove intent on mass destruction,” he says.<\/p>\n\n\n\n

In this case, Becker explains, the tribunal has not yet decided whether genocide has taken place here. “Later in the proceedings, Myanmar can claim that it intended to fight terrorism and paradoxically, even if it was proven that there was ethnic cleansing in Myanmar. According to Becker, even if the tribunal decides that genocide was actually committed in Myanmar, it is unclear what steps the decision will take. “Will the Tribunal order Myanmar to pay restitution to the Rohingya? Will it require Myanmar to rebuild demolished houses and villages? Will it grant renewed property rights to those who have had to flee? So the Rohingya can return to Myanmar with confidence and live with dignity? These are complex questions as well as whether and to what extent Myanmar will uphold the tribunal’s decisions at all, “Becker wonders.<\/p>\n\n\n\n

If this is the case, the question is whether the ICC procedure is merely symbolic and can the international community do more against genocide? According to Becker, “The UN Security Council is unlikely to play a significant role during the tribunal proceedings and even after a decision is reached.” This was evident at a closed council meeting two weeks ago where China vetoed the call to punish those responsible for human rights violations in Myanmar.<\/p>\n\n\n\n

According to Becker, “The interim order is also unlikely to allow refugees to return to Myanmar – if the opposite is true.” He said, “The tribunal’s decision confirms that the situation in Myanmar is very dangerous for the Rohingya and any return there will be premature.” However, Becker believes that the interim order will have some effect. “I believe that overseeing Myanmar will make it difficult for her to continue acting normally.” He said, “The decision between the courts has more of a symbolic effect and it is difficult to determine if it will lead to deeper structural changes.<\/p>\n\n\n\n

Even if Becker’s words leave some room for optimism, history shows that the Rohingya would do well if they held too many hopes in the international institutions. This is the fourth time the ICC has been discussing issues related to the Genocide Convention. Two proceedings that began in the 1990s were related to the former Yugoslav war. Their results were ambivalent and received many years after the conflict ended.<\/p>\n\n\n\n

Another case was filed in Rwanda in 2002, but the tribunal decided it was not his authority to hear it. The international community has dealt with these and other tragedies, to varying degrees of success, also through international criminal tribunals and legal proceedings at the International Criminal Court – which, unlike the International Court of Justice, prosecutes concrete defendants rather than states. In the case of the Rohingya, the two international tribunals are already dealing with the matter but the proceedings, if indeed adopted, will take years. For more than a million and a half Rohingya people, who are in prison and under physical threat in Myanmar and in a severe shortage of camps in Bangladesh, it may already be too late.<\/p>\n","protected":false},"excerpt":{"rendered":"
