The Free Rohingya Coalition refutes the findings of\nMyanmar\u2019s Independent Commission of Enquiry that there is \u201cno\u201d or\n\u201cinsufficient\u201d evidence to establish the genocidal intent behind Myanmar\u2019s\ndestruction of the Rohingya community in Myanmar and the mass deportations of\nestimated 800,000 Rohingyas into Bangladesh in 2016 and 2017.<\/p>\n\n\n\n

Nay San Lwin, the co-founder and coordinator of the\nCoalition, said, \u201cthis is yet another Myanmar commission set up to deny and\ndismiss credible findings of the decades-long and ongoing genocide of our\nRohingya people.  The Commission has not\nestablished facts, but merely handed over a thick pack of lies, distortions and\ndenial for Myanmar\u2019s use at various international tribunals.\u201d<\/p>\n\n\n\n

Despite it being billed as \u201cindependent\u201d (from the\npolitical interference) by State Counsellor Aung San Suu Kyi, the report echoes\nthe line of defence which was offered by Suu Kyi, in her capacity as Myanmar\nAgent, and her legal counsels, in The Gambia vs Myanmar case at the International\nCourt of Justice (ICJ) on 11 and 12 December last year. Both the Commission\u2019s\nreport and legal counsels argued that Myanmar security forces may have used\n\u201cdisproportionate\u201d force, committed war crimes and other human rights\nviolations, but that there were no acts of genocide. These findings play into\nthe hands of the perpetrators who are fully aware that prosecuting them for war\ncrimes and crimes against humanity will not fall within the jurisdiction of the\ncourt.  For ICJ, the United Nations\u2019\nhighest court, handles only legal disputes among UN member states and does not\nprosecute individual state leaders and officials.<\/p>\n\n\n\n

The report\u2019s admission of Myanmar\u2019s wrongdoing –\nthat war crimes, serious human rights violations, and breaking of domestic law\ntook place during the security operations between 25 August and 5 September\n2017 \u2013 merely reiterates Myanmar\u2019s legal argument.  By weighing in on the ICJ case, the report\nhad also contradicted the statement previously made by the Commission Chair\nRosario Manalo, a veteran diplomat from the Philippines, in which she claimed\nthat her commission was not concerned with accountability.  In her words, \u201cit is not a diplomatic\napproach\u2026to be doing finger-pointing, blaming – to say \u2018you\u2019re accountable.\u2019<\/p>\n\n\n\n

In addition, the Free Rohingya Coalition disputes\nthe credibility and reliability of the claim by the Commission that there was\nno \u201cpattern of conduct from which one could reasonably conclude that the acts\nwere committed with \u2018genocidal intent.\u201d \nIt claimed to have covered \u201cthe context and historical background of\nRakhine State.\u201d  Yet legal and human\nrights research studies that have covered the same context and historical\nbackground of Rohingyas of Rakhine have reached the conclusion that Myanmar has\na well-documented policy of discrimination, disenfranchisement, persecution and\nviolence against the Rohingya as a group, with its own distinct identity,\nculture, language and faith over the last 40-years. <\/p>\n\n\n\n

Among the institutions that have published studies\nwhich document and establish this pattern of Myanmar\u2019s systematic and\nidentity-based group destruction of Rohingyas, a UN-protected group, are the\nUniversity of Washington Law School (2014), Queen Mary University of London\ninternational State Crime Initiative (2015), Yale University Lowenstein\nInternational Human Rights Law Clinic (2015) and the United States Holocaust\nMemorial Museum (2017).  Independent of\none another, these credible research institutions have established the common\nfinding \u2013 that Myanmar has adopted a policy of genocidal destruction against\nRohingyas as a group.  The United\nNations-mandated International Independent Fact-Finding Mission and its two\nmajor reports of 2018 and 2019 have only reinforced the findings of the afore-mentioned\nlegal, human rights and genocide studies. \n<\/p>\n\n\n\n

The patterns of Rohingya persecution include the\nde-nationalization of Rohingya as a national minority, forced labour, chronic\ndeportation campaigns, ghettoization, denial of life\u2019s essential services such\nas access to primary and emergency medical services, severely restrictive\nmarriage and birth control measures, summary execution, widespread sexual\nviolence, internment, mass incarceration, severe restriction of movement,  and the state-directed propaganda campaign\nthat Rohingyas do not exist despite the official and historic documents to the\ncontrary.  <\/p>\n\n\n\n

Finally, Suu Kyi\u2019s Independent Commission of Enquiry framed mass deportation, mass deaths and mass destruction of Rohingyas as the result of \u201cdisproportionate use of force\u201d in response to the \u201cinternal armed conflict\u201d between the then-fledgling Arakan Rohingya Salvation Army and Myanmar Armed Forces and Police, without the intent to destroy the Rohingya community, in whole or in part<\/em>.<\/p>\n\n\n\n

Myanmar is a country born out of the World War II\nand is home to the world\u2019s longest armed conflicts between the ethnically\nBurmese governments and their central military and virtually all national\nminorities. There are altogether over 20 armed ethnic organizations, which have\nsprung up since independence from Britain in 1948 throughout all regions of\nnational minorities.  Myanmar has not\nsubjected other ethnic groups, no matter how fierce the armed conflicts are, to\nthe kind of persecution and destruction comparable to what it has against\nRohingyas.  <\/p>\n\n\n\n

In a single year of 2019, the Arakan Army (AA) of\nRakhine Buddhists has fought 600 battles with Myanmar security forces and\nclaimed to have killed 3,000 Myanmar army and police personnel, something which\nMyanmar Ministry of Defence has not denied. \nPro-AA Buddhist Rakhine communities have not been subjected to the same\nsystematic group destruction.   In\ncontrast, the poorly armed Arakan Rohingya Salvation Army managed to kill only\n12 Myanmar security personnel in its 30 raids \u2013 never independently verified \u2013\nat Myanmar military and police outposts between 25 August and 5 September 2017.\n<\/p>\n\n\n\n

Myanmar\u2019s immediate reaction resulted in the\ngenocidal purge of three quarters of a million Rohingyas of whom estimated\n300,000 are school-aged children and young adults; the total destruction of 390\nRohingya villages, complete with 38,000 physical infrastructures including\nmosques, shops, homes, rice warehouses, public halls and so on; the deaths of\nan unknown and uncounted Rohingya deaths believed to run into the tens of\nthousands including babies, toddlers and elderly villagers; and the rape of\nthousands of women.   <\/p>\n\n\n\n

Backgrounder:<\/strong><\/p>\n\n\n\n

In the midst of mounting worldwide allegations of\nMyanmar\u2019s ongoing genocide against Rohingya people, the country\u2019s President Win\nMyint, who serves as Ms Suu Kyi\u2019s proxy, established the Independent Commission\nof Enquiry on 30 July 2018.  It is\nchaired by Ms Rosario Manalo, former Deputy Foreign Minister of the\nPhilippines, and made up of 3 additional commissioners, including Mr Mya Theinn\n(former Director General of the Supreme Court of Myanmar),  Mr Aung Tun Thet (former Director General in\nthe Myanmar Ministry of Health and Business Administration expert) and Mr Kenzo\nOshima, (former Japanese Ambassador to the United Nations and ex-Senior\nVice-President of Japan International Cooperation Agency).  Both Japan and the Philippines have\nconsistently voted against annual United Nations resolutions on Myanmar\ncondemning the Asian pariah for its grave crimes in international law and\ncalling for international accountability.  \nIn addition, the Burmese Commissioner Aung Tun Thet is a highly\ncontroversial Chairman of the Union Enterprise for Humanitarian Assistance,\nResettlement and Development in Rakhine (UEHRD), Myanmar government entity\nestablished by Ms Suu Kyi.  The United\nNations investigators have accused UEHRD of consolidating the\n“consequences of war crimes” as it confiscates vast tracts of land\nthat belonged to Rohingya people who had been genocidally purged in 2016 and\n2017, builds infrastructures on that land and primes its for commercial and\nindustrial-scale agricultural developments.<\/p>\n\n\n\n
